NOTE: The following is a sample Occupancy Agreement provided for reference. A finalized version containing your specific room, dates, and fees will be issued for signature after your reservation is confirmed.

OCCUPANCY AGREEMENT

This Occupancy Agreement (hereinafter referred to as “Agreement”) is entered into as of this _____ day of ___________, 2025, by and between KINDHOUSE RENTALS LLC, a Colorado limited liability company, hereinafter referred to as the "Manager," and ___________________________, hereinafter referred to as the "Occupant." The parties agree as follows:

PROPERTY DESCRIPTION: The Manager agrees to provide the Occupant with access to the room #____ located at ________________________________________ (hereinafter referred to as "the Room") under the terms set forth in this Agreement.

RESERVATION DETAILS: The reservation for the Room is confirmed for check-in on ________________ at 4:00 PM and check-out on ________________ at 10:00 AM. The Occupant agrees to abide by the terms of this Agreement for the entirety of the specified reservation period.

GENERAL STATEMENTS OF AGREEMENT

COMMUNAL LIVING: The acknowledges that they are entering a room in a communal living property managed by the Manager. The Manager’s property fosters a communal environment where guests often form lasting friendships and the Occupant understands and agrees to act respectfully, treat other guests with dignity, and maintain kindness toward fellow occupants at all times.

RESPONSIBILITY: The Occupant is responsible for their actions and must adhere to all terms of this Agreement, ensuring the safety and proper use of the Room and its amenities.

AGE REQUIREMENT: The Occupant must be at least 18 years of age and must provide a valid ID to the Manager prior to booking.

MAXIMUM OCCUPANCY: The Room is limited to one (1) person at all times. No guests are permitted. Unauthorized guests will result in forfeiture of the deposit, occupancy fees, and possible eviction.

MANAGER'S ACCESS: Although Manager intends not to interfere with Occupant's stay at the room, Occupant agrees and understands that Manager shall have the right to enter the room at any time for inspection, make necessary repairs, alterations or improvements, to supply services as agreed or for any reasonable purpose that Manager deems fit. In the event of an emergency, Manager may enter the room at any time.

CONDITION OF ROOM: The Occupant must keep the Room in a clean and sanitary condition. Occupant shall not allow any damage to be committed on any portion of the room, and at the termination of this Agreement, Occupant shall deliver the room to Manager in as good condition as existed at the commencement date of this Agreement. The Occupant agrees will notify the Manager immediately and no later than 24 hours, in writing, of any loss, damage, or defect. Occupant agrees to pay for repairs of all damages. Breach of this condition without written authorization by Manager will result in forfeiture of deposit, occupancy fees, and eviction.

PROHIBITED ACTIVITIES This is not a party house. Organized parties, large social gatherings, or events of any kind whatsoever are strictly prohibited and cause for eviction. Cooking on the deck is not permitted.

LEGAL COMPLIANCE: The Occupant agrees to refrain from illegal activities and to maintain orderly conduct. There shall be no disorderly conduct, excessive and unreasonable noise, lewd behavior, or other conduct that recklessly or intentionally endangers or threatens the health, safety, or welfare of any person or results in dame to the room. Violations may result in eviction and forfeiture of payments.

RISK AWARENESS: The Occupant acknowledges and agrees that the use of the room presents certain physical risks and that at all times the room shall be used with great caution and in extreme safety.

ENCUMBRANCE: The Occupant agrees not to encumber the Room or increase the Manager's insurance liability.

HAZARDOUS CONDITIONS: Upon notification of hazardous conditions, the Manager will undertake necessary repairs as soon as practicable.

MANAGER'S RIGHT OF EVICTION: The Manager reserves the unilateral right to evict the Occupant for good cause or violation of this Agreement. Upon eviction notice, the Occupant must vacate the Room and all personal belongings within one hour. This may result in forfeiture of deposits and occupancy fees, and additional legal action if required. Occupant is also liable to Manager for a fee at an exact rate as the one the Occupant is paying per night for each additional day that Occupant does not vacate room, to be paid in full to Manager within one week of the final date of occupancy. Occupant must pay all costs, including reasonable attorney fees, related to the eviction along with the cost of re-entering, cleaning and repairing the room. Occupant further gives permission to a law enforcement agency to evict Occupant after being notified by Manager. The Manager retains the right to evict the Occupant and their belongings if necessary. Occupants consent to law enforcement intervention if eviction is required.

NON-TENANT RELATIONSHIP: This Agreement does not create a landlord-tenant relationship. This Agreement should not be considered a lease. The room is Manager's personal and private residence, and Manager is merely letting Occupant access and be present on the room during the time specified herein.

HOUSE RULES: The Occupant hereby agrees to comply with the house rules, which are reasonably related to the safety, care and cleanliness of the room and property, as well as the safety, comfort, and convenience of other guests. Such rules may be modified by the Manager from time to time provided that the Occupant receives written notice of any proposed changes prior to their effective date. The house rules are as follows:

1. Respect your fellow housemates and their belongings. This includes maintaining cleanliness in common areas, refraining from disturbing others loud noise or late-night activities, and respecting each person's right to privacy.

2. Adhere to the rules regarding the use of shared facilities, such as the kitchen, laundry room, and common areas. This includes washing dishes after use, not leaving dirty laundry lying around, and not monopolizing shared facilities for extended periods of time.

3. Report any maintenance or repair issues to the Manager promptly to ensure timely and efficient resolution.

4. No illegal activities or substances are permitted on the premises.

5. Smoking is prohibited inside the house.

6. No parties or events are allowed in the house. Please respect our home and neighbors by keeping noise to a minimum.

7. Keep the noise level down after 9 PM to respect your fellow housemates' need for rest and relaxation.

8. To respect the privacy of other guests, visitors are not allowed.

9. If you plan to be away for an extended period of time, please let the Manager know.

10. Please treat the shared house as if it were your own home and respect the space and belongings of others.

PETS: No pets of any kind are permitted on the property.

SMOKING POLICY: Smoking and vaping of any kind are prohibited inside the property. Any and all damages resulting from smoking inside will be billed back to the Occupant including all remediation required to return the property to an acceptable condition and smell. Occupant agrees not to smoke or allow guests to use tobacco or other smoking products. Occupant agrees to be liable for any damage incurred to the room due to smoking, without restriction.

SNOW REMOVAL AND YARD MAINTENANCE: The Manager is responsible for snow removal on the driveway and handling yard and lawn maintenance as soon as it is practicable.

NOISE: The Occupant acknowledges that the property may experience noise from external sources such as cars, planes, neighbors, fireworks, and other surrounding noise sources. Quiet hours are from 9 PM to 7 AM, at which time all excessive music and noise from Occupant shall cease.

FIREWORKS: Fireworks and hazardous materials are prohibited on the property.

INJURY: There is a first aid kit provided for Occupant's convenience. The Occupant must immediately report any injuries and seek prompt medical attention. Occupant must immediately notify Manager of any injury that occurs on the room during the occupancy term and the circumstances surrounding the injury. Manager shall not be liable or responsible for any personal injuries on the room or property due to Occupant's own actions or any other persons that may be upon the rented property. Manager is not responsible for any increased injuries resulting from Occupant's own failure to seek prompt and proper medical attention.

Although Manager believes room to be well cared for and safe, all room can have inherent dangers. Therefore, Occupant understands and agrees that room is rented as is, where is, and that injuries may occur. Occupant shall use extreme care and safety while renting the room. Occupant shall have the obligation to inspect the room upon arrival and shall immediately report any hazardous conditions or repairs needed to the Manager.

FIREARMS AND HUNTING: Firearms are not permitted unless legally registered and kept unloaded at all times. Firearms may not be fired on the room. Hunting on the room is unlawful and strictly forbidden. Firearms may not be fired on the room. Wildlife is to be left undisturbed. In addition, no activity or dangerous sports shall be undertaken that may be hazardous to life or health or that will create injury.

AMENITIES: Occupant understands and agrees that certain amenities may be seasonal and unavailable during the stay. Occupants’ payment obligations are unaffected by amenity availability.

FALSIFIED RESERVATIONS: Any reservation made under false pretenses, including but not limited to providing inaccurate information, misrepresenting the purpose of the stay, or any form of fraud, will be considered material breach of this Agreement. In such cases, the Occupant will not be permitted to check in, and the reservation may be cancelled without notice. The Occupant will be liable for any associated costs or damages resulting from the falsification, including but not limited to lost revenue and administrative fees.

PAYMENT TERMS:

- Short-Term Stays (stays under 28 days):

o A deposit of 50% of the total rental amount is required upon booking.

o The remaining 50% is due seven days prior to the check-in date.

- Long-Term Stays (28 days or more):

o First Month: Rent is due in full at the time of reservation.

o Second Month: Rent is due two weeks prior to the end of the first month.

o Subsequent Months: Rent is due one month after the second month’s payment and on the same date of each subsequent month thereafter.

Payments will be automatically deducted from the Occupant’s card on file.

CANCELLATION FEES AND POLICY: A processing fee of 8% will be applied to all reservations that are cancelled, including any payments made. If the Occupant cancels the reservation prior to the check-in date, the following refund structure will apply:

- Cancellations made 60 days or more before the check-in date: A full refund of all payments made, less a 8% processing fee.

- Cancellations made between 30 days and 59 days before the check-in date: A refund of 50% of payments made, less a 8% processing fee.

- Cancellations made less than 29 days before the check-in date: No refund will be provided.

- Cancellations after the check-in date: No refunds will be provided.

EARLY CHECKOUT POLICY AND RESERVATION ADJUSTMENT POLICY: No refunds will be provided for early checkouts, and no adjustments will be made for any unused nights. All payments are non-refundable once confirmed and are required as specified. Reservations are non-transferable, and no modifications or date adjustments will be permitted, except for extensions. Occupant is allowed to extend the reservation dates for additional nights, but reductions in the length of the stay are not allowed. Any extension must be documented through a signed Addendum to this Agreement, which will specify the new check-out date, additional charges, and applicable terms. Failure to sign the Addendum or make the necessary payments will result in the reservation ending on the original check-out date, as specified in this Agreement. Occupant acknowledges and agrees to be responsible for the full payment of the reservation, regardless of any changes or early departures.

LATE CHECKOUT POLICY: The standard checkout time is 10 AM. Occupant must vacate the room and property by 10 AM as our cleaning staff is scheduled to arrive at the time. To ensure the room is ready for the next guest’s check-in, it must be cleaned promptly. Failure to adhere to the checkout time, resulting in a delay to the cleaning process, will incur a charge for an additional night’s stay. Requests for late checkout may be accommodated based on availability. If the room is reserved for another guest on the same day of checkout, a late checkout will not be possible.

CLEANING FEE: Occupant agrees to pay a non-refundable cleaning fee of $_______ upon reservation, along with the first month’s rent. The property shall be in a clean and sanitary condition at the beginning of the term, and Occupant shall ensure that the room is in clean, neat, and sanitary condition at the end of the term. If additional cleaning is required (beyond what is expected), the Occupant shall pay for any additional cleaning cost.

LOST KEY: A fee of $35.00 will be charged for any lost key and/or lock-outs necessitating Manager’s service. Failure to return the key upon check-out will result in a $35.00 charge. Occupant shall not alter or install any locks or locking devices on any door of the room or property.

GOVERNING LAW: This Agreement shall be governed by the laws of the State of Colorado. Any disputes shall be resolved in Jefferson County, Colorado.

The parties acknowledge that they have fully read, understand, and voluntarily enter into this Agreement, and agree to all terms and conditions.
